Protection of Technologies published in the internet.

The KIPO announced that it would revise the Patent Law and the Utility Model Law keeping in step with changes of the examination atmosphere due to the rapid spread of the internet.
According to KIPO's report, technologies which are published in the internet by inventors before patent applications are also allowed a patent.
This extends the present system making technologies published only in academic associations orexhibitions allowed a patent.
Also, the KIPO plans to abolish a system of opposition to a trial for correction which has been misused to delay the trial in patent disputes.
"Opposition to a trial for correction inflicts enormous economic loss on the disputed parties and its abolishment is expected to terminate a trial at an earlier stage to lessen the loss," said one person at KIPO.
KIPO plans to propose the revised bill to the National Assembly after checking it through public hearings which will be held in April.

Patent Attorneys are insured against their faults.

The Korean Patent Attorneys Association(KPAA) recently effected an insurance contract with Dongbu Fire Insurance Co.
This insurance contract is expected to lessen patent attorneys legal restitution for their faults.
"Until now, patent attorneys have been responsible for their faults in business and particularly small patent offices suffered many difficulties," said person concerned in the KPAA.
Dongbu Fire plans to canvass for the insurance centering around patent attorneys belonging to the KPAA and steadily increase the number of insured.
According to the insurance contract, Dongbu Fire compensates applicants for their loss when the insured patent attorneys don't file applications by the agreed date or don't take suitable measures against the KIPO within the designated period.

The number of patent attorneys which obtain certificates of qualification without examination exceeds half the total number of patent attorneys.

According to the KIPO's report, as of December of last year, the number of registered patent attorneys was 935, but patent attorneys who took an examination are only 391 representing 41.8% of the total number of patent attorneys.
Among patent attorneys without an examination, lawyers are 325 and patent attorneys from KIPO are 219.
Also, patent attorneys from the non-engineering side are 510 while patent attorneys from the science and engineering department are 425, and 319 of the patent attorneys from the humanities majored in law.
Among the patent attorneys from the science and engineering department, 122 patent attorneys practice in chemical and pharmaceutical field, 110 patent attorneys in mechanical and metal field, 105 patent attorneys in electronic and electrical field and 88 patent attorneys in other fields.
As the patent disputes increase more and more, it is expected that more lawyers will serve as patent attorneys at the same time.
Seoul has 808 patent attorneys representing 86% of the total patent attorneys.
Behind Seoul, Daejun has 34 patent attorneys, Kyunggido, 20 and Pusan 17 respectively while Kwangwondo and Jejudo have none.
Also, there are only 96 female patent attorneys representing 10% of the total patent attorneys and among them, 88 took the examination and there are 8 lawyers while there are no patent attorneys from KIPO.
